Pets of Valor Award: Voting Rules
1. Disclosure; Voting Period
NO DONATION, PURCHASE, OR OBLIGATION OF ANY KIND IS NECESSARY TO VOTE. Voting for The Humane Society of the United States' ("The HSUS") 2013 Pets of Valor Award (the "Award") begins at 8:00 a.m. Eastern Standard Time ("EST") on May 24, 2013 and ends at 5:00 p.m. EST on May 31, 2013 (the Voting Period"). All votes must be received during the Voting Period.
To be eligible to vote, you must be thirteen (13) years of age or older as of May 24, 2013. You must have access to the internet and a valid email address in order to vote.
If you are either (a) under eighteen (18) years of age, or (b) under the age of legal majority in your jurisdiction of residence, you must have your parent or legal guardian's permission to participate. Your parent or guardian agrees to ensure that you will comply with these voting rules (the "Voting Rules") and warrants that you are capable of agreeing to these Voting Rules and giving the consent contained herein.
3. How to Vote
The HSUS has selected five (5) finalists for the Award from all eligible nominations received during the Award's nomination period. Finalists were chosen based on the courage or resolve exhibited by the dog or cat to help a human in need and the significance and impact of his/her heroic action. To cast your vote and help your favorite finalist become the 2013 Valor Pet of the Year, visit http://humanesociety.org/petsofvalor or http://www.facebook.com/humanesociety (collectively, the "Websites") during the Voting Period. Complete the voting form, and submit your vote by clicking the "Cast Your Vote" button. Information required on the voting form consists of your first name and email address ("Voter Information"). All required Voter Information must be valid and completed in full or any associated votes will be void.
You may cast no more than one (1) vote per calendar day (the "Voting Limit"). Votes in excess of the Voting Limit will be void and may result in the disqualification of all votes received from the associated voter. Voting must be completed by the actual person casting the vote. You may not vote on behalf of another person or by using an email address that does not belong to you. The exchange of votes for any consideration or incentive of any kind whatsoever (including the exchange of one vote for another) is strictly prohibited. Any such votes will be void and may result in the disqualification of all votes received from the associated voter. Votes must be entered manually. Votes generated by script, macro, bot, or other automated means, votes associated with temporary or disposable email addresses or services, and/or votes which otherwise subvert or impair the integrity of the voting process, as determined by The HSUS in its sole discretion, will be void and may result in the disqualification of all votes received from the associated voter.
4. The Award
The finalist receiving the most eligible votes at the conclusion of the Voting Period will be named the 2013 Valor Pet of the Year. In the event of a tie between any two or more finalists, a judging panel consisting of HSUS staff members will determine the winner based on the courage exhibited by the animal to help a human in need and the significance and impact of his/her heroic action. All decisions of The HSUS and the judging panel are final. No prizes will be awarded to voters.
5. Voting Results
Voting counts and results are not final until reviewed by The HSUS. The HSUS will notify finalists of their status no later than June 2, 2013. In the event the winner is unable to accept the Award, The HSUS will select an alternate. The 2013 Valor Pet of the Year will be announced online on June 2, 2013 at http://humanesociety.org/petsofvalor.
6. Conditions of Participation
By participating in the Award voting, you agree to these rules and the decisions of The HSUS, which will be final and legally binding in all matters related to the Award voting. If, for any reason, voting is not capable of running as planned, or infection by computer viruses, bugs, or tampering, unauthorized intervention, fraud, actions of voters, technical failures, or any other causes corrupt or infect the administration, security, fairness, integrity, or proper conduct of the voting, The HSUS reserves the right at its sole discretion to cancel, terminate, modify, or suspend the voting and, at its sole discretion, determine the winner by tallying all eligible, non-suspect votes, as determined by The HSUS in its sole discretion, validly received prior to the action requiring such modification.
The HSUS may prohibit an individual from taking part in the voting or disqualify a individual's vote(s) if, in its sole discretion, The HSUS determines that said individual is (a) attempting to undermine the legitimate operation of the voting by cheating, hacking, deception, or any other unfair practices (including the use of automated entry programs); or (b) intending to annoy, abuse, or threaten any other participant, voter, finalist, or representative of The HSUS. Any attempt to deliberately damage or undermine the legitimate operation of the Websites may also be in violation of criminal and civil laws. Should such an attempt be made, The HSUS reserves the right to seek remedies and damages (including attorney's fees) from any such individual to the fullest extent of the law, including criminal prosecution.
The HSUS, BOGO Bowl LLC, Uggie, Omar von Muller, Custom Glass Etching, Bella Tocca Tags, and their respective affiliates, officers, directors, employees, independent contractors, representatives, and agents ("Releasees") are not responsible or liable for printing, typographical, technical, human or other errors of any kind, or for stolen, lost, late, misdirected, damaged, incomplete, or illegible votes. Releasees are also not responsible for liable for technical, hardware, software, or telephone failures of any kind; lost, interrupted, or unavailable network connections; fraud; incomplete, garbled, or delayed computer transmissions; and/or damages or losses of any kind arising out of your access to and use of the Websites. Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and/or enforceability of these Voting Rules or the rights and obligations of voters, finalists, winners, or Releasees in connection with the Award shall be governed only by and construed only in accordance with the laws of the District of Columbia for the resolution of all claims and disputes. The Award voting is subject to all applicable international, national, federal, state, provincial, and local laws and regulations and is void where prohibited.
