CHIMPANZEE ART CONTEST VOTING RULES
1. Disclosure; Voting Period
NO DONATION, PURCHASE, OR OBLIGATION OF ANY KIND IS NECESSARY TO VOTE. Voting for The Humane Society of the United States’ (“The HSUS”) Chimpanzee Art Contest (the “Contest”) begins at 8:00 a.m. Eastern Time (“ET”) on August 13, 2013 and ends at 5:00 p.m. ET on August 22, 2013 (the Voting Period”). All votes must be received during the Voting Period.
2. Voter Eligibility
To be eligible to vote, you must be thirteen (13) years of age or older at the time of voting. You must have access to the internet and a valid email address in order to vote.
If you are either (a) under eighteen (18) years of age, or (b) under the age of legal majority in your jurisdiction of residence, you must have your parent or legal guardian’s permission to participate. Your parent or guardian agrees to ensure that you will comply with these voting rules (the “Voting Rules”) and warrants that you are capable of agreeing to these Voting Rules and giving the consent contained herein.
3. How to Vote
The HSUS has invited sanctuary members of the North American Primate Sanctuary Alliance (each a “Sanctuary” and collectively, the “Sanctuaries”) to submit a piece of original artwork created by a resident chimpanzee to raise awareness about chimpanzee retirement issues and to compete for a prize grant from The HSUS. To cast your vote for your favorite chimpanzee artist and help your favorite Sanctuary win a valuable grant from The HSUS, visit http://www.humanesociety.org/chimpart (the “Website”) during the Voting Period. Complete the voting form, and submit your vote by clicking the “Cast Your Vote” button. Information required on the voting form consists of your first name, last name, email address, and zip/postal code (“Voter Information”). All required Voter Information must be valid and completed in full or any associated votes will be void.
You may cast no more than one (1) vote per calendar day (the “Voting Limit”). Votes in excess of the Voting Limit will be void and may result in the disqualification of all votes received from the associated voter. Voting must be completed by the actual person casting the vote. You may not vote on behalf of another person or by using an email address that does not belong to you. The exchange of votes for any consideration or incentive of any kind whatsoever (including the exchange of one vote for another) is strictly prohibited. Any such votes will be void and may result in the disqualification of all votes received from the associated voter. Votes must be entered manually. Votes generated by script, macro, bot, or other automated means, votes associated with temporary or disposable email addresses or services, and/or votes which otherwise subvert or impair the integrity of the voting process, as determined by The HSUS in its sole discretion, will be void and may result in the disqualification of all votes received from the associated voter.
4. Determination of Winning Sanctuaries
At the end of the Voting Period, The HSUS will calculate the total number of eligible votes received for each Sanctuary. The Sanctuary receiving the most eligible votes at the conclusion of the Voting Period will be named the First Prize winner. The Sanctuary receiving the second-highest number of eligible votes will be named the Second Prize winner. The Sanctuary receiving the third-highest number of eligible votes will be named the Third Prize winner. In the event of a tie between any two or more Sanctuaries, a judging panel consisting of an odd number of HSUS staff members who do not directly or indirectly work on The HSUS’s Chimps Deserve Better Campaign will determine the winner based on artistic merit. All decisions of The HSUS and the judging panel are final. No prizes will be awarded to voters.
5. The Grants
Every Sanctuary that participates in the Contest will receive a five hundred dollar ($500 USD) participation grant (“Participation Grant”) from The HSUS to be used solely for the care and maintenance of chimpanzees retired to the Sanctuary from research, the entertainment industry, or the pet trade.
In addition, the First Prize winner, the Second Prize winner, and the Third Prize winner (each individually a “Winner” and collectively, the “Winners”) will each receive an additional prize grant (each a “Prize Grant”) from The HSUS according to the following schedule:
- First Prize: One (1) ten thousand dollar ($10,000 USD) grant to be used solely for the care and maintenance of chimpanzees retired to the Sanctuary from research, the entertainment industry, or the pet trade.
- Second Prize: One (1) five thousand dollar ($5,000 USD) grant to be used as specified above.
- Third Prize: One (1) two thousand five hundred dollar ($2,500 USD) grant to be used as specified above.
6. Voting Results
Voting counts and results are not final until reviewed by The HSUS. The HSUS will notify Winners of their status no later than August 27, 2013. In the event a Winner is unable to accept a Prize Grant, the Sanctuary receiving the next highest number of eligible votes will be named the Winner. The Winners will be announced online on August 29, 2013 at http://www.humanesociety.org/chimpart.
7. Conditions of Participation
By participating in the Contest voting, you agree to these Voting Rules and the decisions of The HSUS, which will be final and legally binding in all matters related to the Contest voting. If, for any reason, voting is not capable of running as planned, or infection by computer viruses, bugs, or tampering, unauthorized intervention, fraud, actions of voters, technical failures, or any other causes corrupt or infect the administration, security, fairness, integrity, or proper conduct of the Contest, The HSUS reserves the right at its sole discretion to cancel, terminate, modify, or suspend the voting and, at its sole discretion, determine the Winners by tallying all eligible, non-suspect votes, as determined by The HSUS in its sole discretion, validly received prior to the action requiring such modification.
The HSUS may prohibit an individual from taking part in the voting or disqualify a individual’s vote(s) if, in its sole discretion, The HSUS determines that said individual is (a) attempting to undermine the legitimate operation of the voting by cheating, hacking, deception, or any other unfair practices (including the use of automated voting programs); or (b) intending to annoy, abuse, or threaten any participant, voter, Sanctuary, or representative of The HSUS. Any attempt to deliberately damage or undermine the legitimate operation of the Website may also be in violation of criminal and civil laws. Should such an attempt be made, The HSUS reserves the right to seek remedies and damages (including attorney’s fees) from any such individual to the fullest extent of the law, including criminal prosecution.
The HSUS, Dr. Jane Goodall, and their respective affiliates, officers, directors, employees, independent contractors, representatives, and agents (individually and collectively, the “Releasees”) are not responsible or liable for printing, typographical, technical, human, or other errors of any kind, or for stolen, lost, late, misdirected, damaged, incomplete, or illegible votes. Releasees are also not responsible or liable for technical, hardware, software, or telephone failures of any kind; lost, interrupted, or unavailable network connections; fraud; incomplete, garbled, or delayed computer transmissions; and/or damages or losses of any kind arising out of your access to and use of the Website. Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and/or enforceability of these Voting Rules or the rights and obligations of voters, Sanctuaries, Winners, or Releasees in connection with the Contest shall be governed only by and construed only in accordance with the laws of the District of Columbia for the resolution of all claims and disputes. The Contest voting is subject to all applicable international, national, federal, state, provincial, and local laws and regulations and is void where prohibited.
