2013 State Legislative Pet Photo Contest Official Contest Rules
1. Disclosure; Contest Period
No donation, purchase, or obligation of any kind is necessary to win. A donation or purchase will not increase your chances of winning. You have not yet won. Entries for the "2013 State Legislative Pet Photo Contest" Contest ("Contest") will be accepted during different periods for different states, as indicated on the Contest website located at http://www.humanesociety.org/forms/2013_state_legislative_pet.html ("Contest Website"). The submission period for your state of residence shall apply to your entry and constitutes your "Submission Period" for purposes of the Contest and these Official Contest Rules. Your entry must be submitted during the applicable Submission Period to be eligible.
Contest open only to current members and staff of the state legislatures of participating states, as indicated on the Contest Website. Entrants must be eighteen (18) years of age or older. Void where prohibited by law. The Contest is subject to all applicable federal, state, and local laws and regulations. Employees and independent contractors of The Humane Society of the United States ("The HSUS") or its affiliates, and any other individual or entity involved in the development, promotion, or execution of the Contest, and the immediate family members and/or household members of each are not eligible.
3. To Enter
To enter, submit your photo and complete an entry form via the entry submission page located on the Contest Website. You may also include an optional explanation of why your pet should "win by a landslide." Only photos of dogs and cats should be submitted for the "Most Adorable Dog" and "Most Adorable Cat" categories, respectively. Photos of other animals may be submitted for the "Most Adorable Furry or Feathered Friend" category. No photos of wild or exotic animals may be submitted in any category. Submitted photos must be in JPEG (.jpg or .jpeg) or non-animated GIF (.gif) digital format with an image resolution of at least 300 dpi at 5x7 inches and a file size of roughly three (3) MB or larger. If your photo contains the images of other individuals or groups, you must obtain permission from each and every individual or group who contributed to or is featured in the photo (or if the individual is under eighteen (18) years of age, from the individual's parent or legal guardian) before submitting the photo. An entry will be deemed ineligible if it is illegible, incomplete, if it fails to meet the required specifications, or if it is received before the applicable Submission Period begins or after it ends. All entries shall become the property of The HSUS when received and shall not be returned.
By entering the Contest, you warrant that your entry is original, that you are the sole owner and copyright holder of your entry, and that you have not granted exclusive rights to all or part of your entry to any other person or entity. You also warrant that your entry does not invade the right of privacy of any individual; does not infringe any trademark, trade name, trade secret, intellectual property right, or other common law or statutory right; nor does it contain any material that might be deemed offensive or obscene, or that otherwise violates any criminal prohibition or the personal or proprietary rights of any person or entity. The HSUS reserves the right, in its sole discretion, to remove any submitted photo from the Contest and its related websites for any reason whatsoever at any time and without any consent from or notice to you.
4. How the Winners Will Be Determined
Three (3) winners will be selected from each participating state (the "Winners"). One (1) Winner in each state will be selected from each of the three categories: "Most Adorable Dog," "Most Adorable Cat," and "Most Adorable Furry or Feathered Friend."
The Winners from each state will be selected by a panel of judges from among the eligible entries based on the quality of the Winners' entries. Judging panels will be composed of The HSUS staff and/or guest judges. To request the composition of the judging panel for your state, please contact The HSUS at firstname.lastname@example.org. All decisions of judging panels are final.
Each Winner will receive one (1) congratulatory plaque.
6. Winner Notification/Prize Claims
The Winners for a participating state will be selected prior to the "2013 Humane Lobby Day" event organized by HSUS for that state and the Winners for that state will be notified at the event. If a Winner is unable to attend the event, they will be notified via email. In the event that a Winner is unable to accept a prize, an alternate Winner will be selected. In the event of noncompliance with these Official Contest Rules, or if a prize or prize notification is unclaimed or returned as undeliverable, the prize will be forfeited and may be awarded to an alternate winner.
7. Prize Restrictions
Prizes are not transferable. No substitution of prizes is permitted except at the sole discretion of The HSUS. Any federal, state, or local taxes on prizes and any expenses related to the acceptance and/or use of the prizes not specified herein as being awarded are the responsibility of the Winners
8. Additional Terms
By entering the Contest, each contestant agrees to grant to The HSUS, its affiliates, and their legal representatives, successors, and assigns the nonexclusive right and permission to use, modify, adapt, reproduce, publish, and distribute his/her entry, or any portion thereof, including the submitted photo, throughout the world, in any printed form and by any kind of mechanical or electronic or any other method or device of reproduction, publication, and distribution now known or later developed, during the full term of the copyright, and without notification or payment, in connection with the Contest.
By accepting a prize, a Winner consents to The HSUS's use of the Winner's name, likeness, voice, and/or biographical information for promotional and other purposes without additional compensation, except where prohibited by law.
A Winner, by acceptance of any prize, acknowledges compliance with these Official Contest Rules and agrees to release The HSUS, its affiliates, and its officers, directors, employees, independent contractors, representatives, and agents ("Releasees") from and against any claim or cause of action arising out of participation in the Contest or the receipt, redemption, or use of any prize, including any injuries or damages of any kind sustained in connection with the use, acceptance, possession, or awarding of any prize.
9. Limitation of Liability
Releasees are not responsible for printing, typographical, human or other errors of any kind in any contest-related materials or for stolen, lost, late, misdirected, damaged, incomplete, or illegible entries. If, for any reason, the Contest is not capable of running as planned, or infection by computer viruses, bugs, or tampering, unauthorized intervention, fraud, actions of entrants, technical failures, or any other causes corrupt or infect the administration, security, fairness, integrity, or proper conduct of the Contest, The HSUS reserves the right at its sole discretion to disqualify any entry or entrant and/or to cancel, terminate, modify, or suspend the Contest and at its sole discretion award a prize from among all eligible non-suspect entries validly received prior to the action requiring such modification. By entering, all contestants agree that the Contest is governed by laws of the District of Columbia for the resolution of all claims and disputes (excluding any claims against or disputes involving parties other than The HSUS relating to any prize awarded in the contest).
