#TAKEYOURPET CONTEST OFFICIAL RULES


1. Disclosure; Voting Period 

NO DONATION, PURCHASE, OR OBLIGATION OF ANY KIND IS NECESSARY TO WIN. A DONATION OR PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. YOU HAVE NOT YET WON. The #TakeYourPet Contest (the “Contest”) begins at 12:01 a.m. Eastern Time (“ET”) on September 1, 2013 and ends at 11:59 p.m. ET on September 30, 2013 (the “Contest Period”). Entries must be submitted by September 30, 2013 to be eligible.



2. Eligibility

The Contest is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. Employees and independent contractors of The Humane Society of the United States (“The HSUS”), its affiliates, and any other individual or entity involved in the development, promotion, or execution of the Contest, and the immediate family members and/or household members of each are not eligible. You must have access to the internet and an authorized, non-private, individual account with Twitter, Inc. (“Twitter”) in order to enter or win. In order to enter the Video Category (as defined in § 3, below) you must also have an account with either Vine Labs, Inc. (“Vine”) or Instagram, LLC (“Instagram”). The Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.



3. To Enter

In order to enter the Contest, you must be a registered user of Twitter, and you must be currently following The HSUS (@HumaneSociety) on Twitter. If you do not have a Twitter account, you will need to create one in order to enter. Your Twitter account must set so that your tweets are public. For more information on how to do this, please visit https://support.twitter.com/articles/20169886-how-to-protect-and-unprotect-your-tweets. To follow The HSUS (@HumaneSociety) on Twitter, visit http://www.twitter.com/HumaneSociety while logged in to your Twitter account and click the “Follow” button. There is no charge associated with creating an account on Twitter or following The HSUS.

You may enter the Contest in one (1) or more of the following two (2) categories (each a “Category”):

  • "Photo Category”: Includes entries that contain digital photographs
  • “Video Category”: Includes entries that contain digital videos

Entrants in the Contest will only compete against other entrants in their Category. To enter the Contest, follow the instructions below to submit an entry to the Category of your choice:

To enter the Photo Category: Using a device with camera functionality, take a digital photograph depicting the disaster preparedness kit that you have assembled for your pet (the “Photo”). Share the Photo on Twitter, and include the #takeyourpet hashtag in your tweet. You can share your Photo either by uploading the Photo directly through Twitter or by posting the Photo to Twitter using another linked social media application (e.g., Instagram).

To enter the Video Category: You must be a registered user of either Vine or Instagram in order to enter the Video Category. There is no charge associated with creating an account on either Vine or Instagram. To enter the Video Category, log in to either your Vine or your Instagram account, and using a device with video functionality, record an original video depicting the disaster preparedness kit that you have assembled for your pet (the “Video”). Please note that Videos recorded using Vine are limited to six (6) seconds in length, and Videos recorded using Instagram are limited to fifteen (15) seconds in length. Once you have recorded your Video, share the Video on Twitter, and include the #takeyourpet hashtag in your tweet. Please note that you will need to link your Vine or Instagram account with your Twitter account in order to share the Video on Twitter and enter the Video Category.

If you complete the foregoing during the Contest Period and otherwise comply with these official contest rules (the “Official Rules”), you will receive one (1) entry into the Contest (each hereinafter an “Entry,” and collectively, the “Entries”) in either the Photo Category (if your Entry contains a Photo) or the Video Category (if your Entry contains a Video). Limit one (1) Entry per Category per person and per account (the “Entry Limit”). All Entries received in excess of the Entry Limit will be disqualified. Use of scripts, macros, other automated entry software or programs, and/or other means or practices which subvert the entry process is prohibited, and all Entries received in such a manner will be disqualified. Further, creating multiple accounts of any kind for the purposes of exceeding the Entry Limit may result in disqualification of the associated entrant. Multiple entrants may not share the same account on any social media service, including, but not limited to, Twitter, Vine, and Instagram. Entries will be deemed to be submitted by the authorized account holder of the Twitter account associated with the Entry. For purposes of these Official Rules, the “authorized account holder” is defined as the natural person who is assigned to a Twitter account by Twitter. If the tweet containing an Entry is subsequently deleted, the associated Entry will be deemed ineligible and will be removed from consideration. Entries will not be acknowledged by The HSUS.

Your Entry must comply with the Entry Requirements set forth in § 4 of the Official Rules, the Twitter terms of service (currently available at http://twitter.com/tos), and, if you are submitting an Entry through Vine, Instagram, or any other social media application, the Vine terms of service (currently available at http://vine.co/terms), the Instagram terms of use (currently available at http://instagram.com/legal/terms), and/or the applicable terms of service for the social media application used, respectively. Please read the Entry Requirements and the Official Rules before submitting your Entry, and follow directions carefully.

If you use Twitter, Vine, and/or Instagram or otherwise participate in the Contest via a wireless mobile device, standard text messaging and/or data rates may. Other charges may also be applied by your wireless carrier. Participation by wireless mobile device is not a condition of entry. Please contact your wireless carrier for more information regarding your service plan.

By entering the Contest, you agree to be bound by these Official Rules and the decisions of The HSUS and the judging panel, which shall be final and binding in all respects. Further, by entering the Contest, you represent and warrant that your Entry complies with the Entry Requirements and the Official Rules, and you agree that The HSUS may deem your Entry ineligible if it determines, in its sole discretion, that your Entry fails to conform to the Entry Requirements or otherwise violates the Official Rules.



4. Entry Requirements

Each Entry must comply with the following requirements (collectively, the “Entry Requirements”):

  • Entries must be received during the Contest Period. Entries received by The HSUS before the Contest Period begins or after it ends are not eligible.
  • Only Entries that are submitted through Twitter and that include the #takeyourpet hashtag are eligible. Entries received by mail, email, facsimile, or otherwise will be deemed ineligible.
  • Entries to the Video Category must be created using either Vine or Instagram to be eligible.
  • Entries must be entirely in English.
  • All content contained in the Entry (including, without limitation, the Photo, Video, or other text contained in the tweet) must be the original creation of the entrant. Modifying, altering, or enhancing a third-party’s pre-existing work does not qualify as an entrant’s original creation.
  • You must be the sole owner and copyright holder of any content contained in your Entry. You must have the right to submit your Entry and to transfer and assign to The HSUS all rights in your Entry. You must not have granted exclusive rights to all or part of your Entry to any other person or entity. Entries containing content that has been published, is awaiting publication, or has won other contests are not eligible.
  • If the name, likeness, or other identifying information of another individual appears in your Entry, you must have obtained prior permission from such individual (or if such individual is under eighteen (18) years of age, from such individual’s parent or legal guardian) to use his/her name, likeness, or other identifying information in your Entry.
  • You must be the legal owner or permanent caretaker of any animal(s) depicted in your Entry, or if you are not the legal owner or permanent caretaker of such animal(s),. you must have obtained prior permission from the legal owner or permanent caretaker of the animal(s) to depict the animal(s) in your Entry.
  • Entries must not contain any material that (a) invades the right of privacy of any individual; (b) infringes any trademark, trade name, trade secret, intellectual property right, or other common law or statutory right; (c) is unlawful, harmful, abusive, harassing, tortious, defamatory, vulgar, obscene, sexually explicit, libelous, hateful, or racially, ethnically, or otherwise objectionable as determined by The HSUS in its sole discretion; (d) violates any applicable local, state, or federal law or regulation; or (e) violates any term or provision of these Official Rules.

The HSUS alone shall determine whether an Entry complies with the above Entry Requirements, and all decisions of The HSUS will be final. If your Entry fails to comply with the above Entry Requirements, as determined by The HSUS in its sole discretion, The HSUS may deem your Entry ineligible. Without limitation, The HSUS also reserves the right, in its sole discretion, to deem any Entry ineligible if it reflects negatively upon The HSUS, the Contest, or any other person or entity; is the subject of a notification of potential infringement or violation of law; is otherwise unsuitable for presentation in a public forum; or for any other reason at the sole discretion of The HSUS.



5. How the Winner Will Be Determined

A panel of judges comprised of members of The HSUS’s staff will select one (1) winner from the Photo Category and one (1) winner from the Video Category (each a  “Winner” and collectively the “Winners”) from among the eligible entries. Entries will be judged based on (a) entrant’s embodiment of the Theme; (b) the creativity exhibited by the entrant; and (c) the quality of the Entry. Judging will take place on or about October 1, 2013. All decisions of the judging panel are final.


6. Prizes

Each Winner will receive one (1) HSUS swag bag including a variety of items from The HSUS’s online store.  The approximate retail value (“ARV”) of the swag bag is one hundred dollars ($100 USD). The Winners’ Entries will be displayed on The HSUS’s website and/or The HSUS’s social media accounts, including, but not limited to, The HSUS’s Facebook page and/or Twitter account. There is no cash value attributed to being featured on The HSUS’s website and/or The HSUS’s social media accounts.

The total ARV of all Contest prizes is two hundred dollars ($200 USD).



7. Winner Notification/Prize Claims

The Winners will be selected by October 1, 2013. On or about October 4, 2013, each Winner will be notified via Twitter by a direct message from @HumaneSociety to the Twitter account used by Winner to enter the Contest. In order to receive such notification via a direct message, the Winner must be currently following @HumaneSociety and his/her tweets must be public. The Winner will be required to verify his/her identity (including, but not limited to, proof that he/she is the authorized account holder of the Twitter account associated with the winning Entry) and provide his/her contact information within one (1) week from such notification. The Winner will also be required to complete and sign an Affidavit of Eligibility, a Liability Release, and, where legal, a Publicity Release, all of which must be returned within two (2) weeks of attempted prize notification or the prize will be forfeited and awarded to an alternate winner. In the event that a Winner is unable to accept a prize, an alternate Winner will be selected. Further, in the event of noncompliance with these Official Rules, or if a prize or prize notification is unclaimed or returned as undeliverable, the prize will be forfeited and may be awarded to an alternate Winner.


8. Prize Restrictions

Prizes are not transferable. No substitution of prizes is permitted except at the sole discretion of The HSUS, and The HSUS reserves the right to substitute a prize or any portion thereof with one of equal or greater value. Any federal, state, local or other taxes of any kind on prizes and any expenses related to the acceptance and/or use of the prizes not specified herein as being awarded are the responsibility of the Winner. If a prize is won by an eligible person who is not of legal age in his or her state of residence, the prize shall be awarded in the name of the Winner’s parent or legal guardian, who will assume all responsibilities of the minor Winner.


9. Additional Terms

By entering the Contest, each entrant agrees to grant to The HSUS, its affiliates, and their legal representatives, successors, and assigns the nonexclusive right and permission to use, modify, adapt, reproduce, publish, and distribute his/her Entry, or any portion thereof, throughout the world, in any printed form and by any kind of mechanical or electronic or any other method or device of reproduction, publication, and distribution now known or later developed, during the full term of the copyright, and without notification or payment, in connection with the Contest and/or The HSUS’s disaster preparedness campaign(s).

By entering the Contest, each entrant acknowledges compliance with the Official Rules and agrees to release The HSUS, its affiliates, and their respective officers, directors, employees, independent contractors, representatives, and agents (“Releasees”) from and against any claim or cause of action arising out of participation in the Contest or the receipt, redemption, or use of any prize, including any injuries or damages of any kind sustained in connection with the use, acceptance, possession, or awarding of any prize.

By accepting a prize, the Winner consents to The HSUS’s use of the Winner’s name, likeness, voice, and/or biographical information for promotional and other purposes related to the Contest and/or The HSUS’s disaster preparedness campaign(s) without notification or additional compensation, except where prohibited by law.


10. Limitation of Liability

Releasees are not responsible for printing, typographical, human, or other errors of any kind in any Contest-related materials or for stolen, lost, late, misdirected, damaged, incomplete, undelivered, unintelligible, or illegible Entries. Releasees are also not responsible for malfunctions of electronic equipment, computer hardware, or software; problems entering the Contest; or other technical problems related to any website, including, without limitation, any injury or damage to any computer or computer equipment related to or resulting from participation in the Contest. Releasees are not responsible in any way for any decisions any social media application used by entrant in participating in the Contest (including, but not limited to, Twitter, Instagram, and/or Vine) makes regarding any entrant’s account with such social media application. Releasees make no warranty, representation, or guarantee, whether express or implied, in fact or in law, relative to the use of any prize or any portion thereof. 

If, for any reason, the Contest is not capable of running as planned, or infection by computer viruses, bugs, or tampering, unauthorized intervention, fraud, actions of entrants, technical failures, or any other causes corrupt or infect the administration, security, fairness, integrity, or proper conduct of the Contest, The HSUS reserves the right at its sole discretion to disqualify any Entry or entrant and/or to cancel, terminate, modify, or suspend the Contest and at its sole discretion award a prize from among all eligible non-suspect Entries validly received prior to the action requiring such modification. Persons found to be tampering with or abusing any aspect of the Contest, as determined solely by The HSUS, will be disqualified along with all associated Entries. By entering the Contest, all entrants agree that the Contest is governed only by the laws of the District of Columbia for the resolution of all claims and disputes (excluding any claims against or disputes involving parties other than The HSUS relating to any prize awarded in the Contest).


11. Privacy

Information submitted in connection with the Contest will be treated in accordance with these Official Rules and The HSUS’s privacy policy (the “Privacy Policy”), which may be amended from time to time and which is currently available at http://www.humanesociety.org/privacy_policy.html. If there is any conflict between these Official Rules and the Privacy Policy, the terms and conditions of the Official Rules shall prevail.

13. Sponsor

The HSUS (2100 L Street, N.W., Washington DC 20037) is the sole sponsor of the Contest. Vine Labs, Inc., Instagram, LLC, and Twitter, Inc. are not sponsors of the Contest and in no way endorse or are responsible for the administration of the Contest.
