Official Contest Rules for the "Why Puppy Mills Stink" Video Contest

 

1. Disclosure; contest period

No donation, purchase, or obligation of any kind is necessary to win. A donation or purchase will not increase your chances of winning. You have not yet won. The "Why Puppy Mills Stink" CONTEST ("Contest") begins at 12:00 am Eastern Standard Time (EST) on 04/15/2012 and ends at 11:59 p.m. EST on 5/6/2012 ("Contest Period"). Entries must be submitted by 5/6/2012 to be eligible.

2. Eligibility

You must be thirteen (13) years of age or older to enter. If you are under eighteen (18) years of age, you may only enter the Contest with the permission of your parent or guardian. The parent or legal guardian of an entrant under the legal age of majority in his/her jurisdiction of residence agrees to ensure that the entrant will comply with these Official Contest Rules and warrants that the entrant is capable of agreeing to these Official Contest Rules and giving the consent contained herein. Contest open to United States residents only. Void where prohibited by law. The Contest is subject to all applicable federal, state, and local laws and regulations. Employees and independent contractors of The Humane Society of the United States ("The HSUS") or its affiliates, and any other individual or entity involved in the development, promotion, or execution of the Contest, and the immediate family members and/or household members of each are not eligible.

3. To enter

To enter, submit a video by posting a response on YouTube. After you have submitted your video, complete all parts of the Official Entry Form online at www.humanesociety.org/puppymillsstink. Video submissions should address the topic of "Why Puppy Mills Stink" and must be no longer than ninety (90) seconds in length. Submissions may only include original music. Video submissions may only include video of puppy mills available from The HSUS on YouTube. Any video submission that uses any other content, such as unauthorized music, video, or images, will be disqualified.

All contestants must complete an Official Entry Form online, including their first name, last name, email address, mailing address and contact phone number. Video submissions must be original, must not have been published, broadcast, or otherwise publicly distributed previously, and must not infringe on any third party rights. An entry will be deemed ineligible if it is illegible, incomplete, if it fails to meet the required specifications, or if it is received before the Contest Period begins or after it ends. All entries shall become the property of The HSUS when received and shall not be returned.

By entering the Contest, you (or, if you are an eligible minor, your parent or guardian) warrant that your entry is original, that you are the sole owner and copyright holder of your entry, and that you have not granted exclusive rights to all or part of your entry to any other person or entity. You (or, if you are an eligible minor, your parent or guardian) also warrant that your entry does not invade the right of privacy of any individual; does not infringe any trademark, trade name, trade secret, intellectual property right, or other common law or statutory right; nor does it contain any material that might be deemed offensive or obscene, or that otherwise violates any criminal prohibition or the personal or proprietary rights of any person or entity.

4. How the winner will be determined

There are two ways to win the Contest:

Judged category

A panel of judges composed of supporters and members of The HSUS Puppy Mills Campaign will select five (5) videos as finalists based on originality, expression, and video content. From the five (5) finalist videos, the panel will choose one (1) Winner of the Judged Category.

People’s choice category

All validly entered videos will be listed on the People's Choice voting webpage. From 12:00 a.m. EST on May 7, 2012 to 11:59 p.m. EST on May 10, 2012 ("Voting Period"), the webpage will be open to the public and individuals may vote for their favorite video. An individual may cast only one vote per day, but may vote any number of days during the Voting Period. At the end of the Voting Period, The HSUS staff members will count the number of validly received votes acquired by each entry during the Voting Period. The contestant whose entry receives the highest number of valid votes during the Voting Period will be considered the Winner of the People’s Choice Category. In the event of a tie, all contestants whose entries receive the highest number of valid votes will be considered Winners of the People’s Choice Category and will receive the associated prize.

5. Prizes

The Winner in the Judged Category will have his/her winning video broadcast on television stations in the Winner's home state and in other select media markets at HSUS’s sole discretion. The HSUS makes no guarantees as to the frequency with which the Winner’s video will be aired.

The Winner(s) of the People’s Choice category will have his/her winning video featured on The HSUS’s website.

6. Winner notification/prize claims

The Winners will be selected by 05/11/2012 and will be notified via email by 06/1/2012. In the event that a Winner is unable to accept a prize, an alternate Winner will be selected. Each Winner will be required to complete and sign an Affidavit of Eligibility and Liability Release, and, where legal, a Publicity Release, all of which must be returned within thirty (30) days of attempted prize notification or the prize will be forfeited and awarded to an alternate Winner. If the prize is won by an eligible person who is not of legal age in his/her jurisdiction of residence, the prize shall be awarded in the name of the Winner’s parent or legal guardian, who must sign and return all required documentation prior to receiving the prize. In the event of noncompliance with these Official Contest Rules, or if a prize or prize notification is unclaimed or returned as undeliverable, the prize will be forfeited and may be awarded to an alternate Winner.

7. Prize restrictions

Prizes are not transferable. No substitution of prizes is permitted except at the sole discretion of The HSUS. Any federal, state, or local taxes on prizes and any expenses related to the acceptance and/or use of the prizes not specified herein as being awarded are the responsibility of the Winners.

8. Additional terms

By accepting a prize, each Winner (or, in the case of an eligible minor, his/her parent or guardian) consents to The HSUS’s use of the Winner’s name, likeness, voice, and/or biographical information for promotional and other purposes without additional compensation, except where prohibited by law. Each Winner (or, in the case of an eligible minor, his/her parent or guardian) by acceptance of any prize, acknowledges compliance with these Official Contest Rules and agrees to release The HSUS, its affiliates, and its officers, directors, employees, independent contractors, representatives, and agents ("Releasees") from and against any claim or cause of action arising out of participation in the Contest or the receipt, redemption, or use of any prize, including any injuries or damages of any kind sustained in connection with the use, acceptance, possession, or awarding of any prize.

By entering the Contest, entrants and, in the case of eligible minors, their parents and guardians, agree to grant to The HSUS, its affiliates, and their legal representatives, successors, and assigns the nonexclusive right and permission to use, modify, adapt, reproduce, publish, and distribute an entry, or any portion thereof, throughout the world, in any printed form and by any kind of mechanical or electronic or any other method or device of reproduction, publication, and distribution now known or later developed, during the full term of the copyright, and without notification or payment, in connection with the Contest.

9. Limitation of liability

Releasees are not responsible for printing, typographical, human or other errors of any kind in any contest-related materials or for stolen, lost, late, misdirected, damaged, incomplete, or illegible entries. If, for any reason, the Contest is not capable of running as planned, or infection by computer viruses, bugs, or tampering, unauthorized intervention, fraud, actions of entrants, technical failures, or any other causes corrupt or infect the administration, security, fairness, integrity, or proper conduct of the Contest, The HSUS reserves the right at its sole discretion to disqualify any entry or entrant and/or to cancel, terminate, modify, or suspend the Contest and at its sole discretion award a prize from among all eligible non-suspect entries validly received prior to the action requiring such modification. By entering, all contestants agree that the Contest is governed by laws of the District of Columbia for the resolution of all claims and disputes (excluding any claims against or disputes involving parties other than The HSUS relating to any prize awarded in the contest).
