Defenders of Wildlife, The HSUS, et al. v. Gutierrez, et al. (Right whales)
Suit against the National Marine Fisheries Service for failing to set vessel speed limits to protect the North Atlantic right whales from collisions with ships. Suit also alleged the Coast Guard failed to consider how the location of shipping lanes affects endangered whales. In July 2008, the D.C. Circuit agreed that the Endangered Species Act requires the Coast Guard determine whether shipping lanes may jeopardize whales.
