Kind News Cover Contest Official Rules

1. Disclosure; Contest Period

NO DONATION, PURCHASE, OR OBLIGATION OF ANY KIND IS NECESSARY TO WIN. A DONATION OR PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. YOU HAVE NOT YET WON. The Kind News Cover Contest (the “Contest”) begins at 12:00 p.m. Eastern Time (“ET”) on August 14, 2013 and ends at 11:59 p.m. ET on December 10, 2013 (the “Contest Period”). All Entries must be received by December 10, 2013 to be eligible.

2. Eligibility

The Contest is open only to legal residents of the fifty (50) United States and the District of Columbia who, at the time of entry, are students between the ages of five (5) and fourteen (14) and are enrolled in kindergarten through sixth grade. All entrants must have the permission of their parent or legal guardian to enter the Contest. Employees and independent contractors of The Humane Society of the United States (“The HSUS”), its affiliates, and any other individual or entity involved in the development, promotion, or execution of the Contest, and the immediate family members and/or household members of each are not eligible. You must have access to the internet and a printer in order to enter or win. The Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.

3. How to Enter

The Contest is open to three (3) categories of entrants (each a “Category,” and collectively the “Categories”):

  • “Primary Category”: Individual entrants who are enrolled in kindergarten, first grade, or second grade at the time of entry.
  • “Junior Category”: Individual entrants who are enrolled in either the third or fourth grade at the time of entry.
  • “Senior Category”: Individual entrants who are enrolled in either the fifth or the sixth grade at the time of entry.

Entrants in the Contest will only compete against other entrants in their Category.

To enter the Contest, visit humanesociety.org/kncovercontest during the Contest Period, and follow the directions to download and print the entry form (the “Entry Form”) and the cover design template (the “Template”). Complete the required sections of the Entry Form in their entirety, including the parental consent information, and have your parent or guardian sign the Entry Form where provided. A parent or guardian’s signature on the Entry Form is required to enter the Contest. Entries without a parent or guardian’s signature will be disqualified. If the entry was submitted with assistance from a teacher or animal shelter/rescue, have the assisting teacher (the “Assisting Teacher”) or an authorized representative of the assisting rescue/shelter (the “Assisting Shelter”) complete and sign the section of the Entry Form labeled “Teacher/Shelter Coordinated Submissions.” Only one (1) Assisting Teacher or one (1) Assisting Shelter may be listed. Then, design an original cover for Kind News that depicts an adopted pet living happily in its new home (the “Theme”) on the Template. Do not modify, alter, or change the basic design/layout of the Template.

Once you have completed the Entry Form in its entirety and have designed your Kind News cover on the Template, mail the completed Entry Form and Template to:

The Entry Form and Template together comprise your entry into the Contest (each an “Entry,” and collectively, the “Entries”). Limit one (1) Entry per person. All Entries received in excess of the stated limitation will be disqualified. Each Entry must comply with the Entry Requirements set forth in § 4 of these official contest rules (the “Official Rules”). Please read the Entry Requirements and the Official Rules before submitting an Entry, and follow directions carefully. Once an Entry is submitted, it cannot be modified or withdrawn.

By submitting an Entry (or, in the case of an entrant’s parent or legal guardian, by signing and submitting the Entry Form), entrant and his/her parent or legal guardian agree to be bound by these Official Rules and the decisions of The HSUS and the judging panel, which shall be final and binding in all respects. Further, by submitting an Entry (or, in the case of an entrant’s parent or legal guardian, by signing and submitting the Entry Form), entrant and his/her parent or legal guardian represent and warrant that the Entry complies with the Entry Requirements, as defined in § 4 of these Official Rules, and agree that The HSUS may deem the Entry ineligible if it determines, in its sole discretion, that the Entry either fails to conform to such Entry Requirements or otherwise violates the Official Rules.

All Entries shall become the property of The HSUS when received and will not be acknowledged or returned.

4. Entry Requirements

Each Entry must comply with the following requirements (collectively, the “Entry Requirements”):

  • Entries must be submitted via U.S. mail to the address listed in § 3 of these Official Rules. Submissions received by email, facsimile, or otherwise will be deemed ineligible.
  • All Entries must be received by December 10, 2013. Entries received after December 10, 2013 are not eligible. Please plan accordingly and allow enough time for delivery through the U.S. mail.
  • Entries must be complete, containing responses to all required questions and a parent or guardian’s signature on the Entry Form, and a cover design on the Template. All Entries must be in English.
  • Only one (1) Assisting Teacher or one (1) Assisting Shelter may be named on the Entry Form. Entries including multiple Assisting Teachers and/or Assisting Shelters will be ineligible.
  • The artwork contained on the Template must be the original and independent creation of the entrant. Modifying, altering, or enhancing a third-party’s pre-existing work does not qualify as an entrant’s original creation. An entrant’s parent, legal guardians, and/or teacher may provide guidance and support, but the artwork on the Template must be created solely by the entrant.
  • Entrant must be the sole owner and copyright holder of any content contained in his or her Entry. Entrant must have the right to submit his or her Entry and to transfer and assign to The HSUS all rights in his or her Entry. Entrant must not have granted exclusive rights to all or part of his or her Entry to any other person or entity. The Entry and/or any portion thereof must not have been (a) entered in any other competition, or (b) previously published.
  • Entries must not contain any material that (a) invades the right of privacy of any individual; (b) infringes any trademark, trade name, trade secret, intellectual property right, or other common law or statutory right; (c) is unlawful, harmful, abusive, harassing, tortious, defamatory, vulgar, obscene, sexually explicit, libelous, hateful, or racially, ethnically, or otherwise objectionable as determined by The HSUS in its sole discretion; (d) violates any applicable local, state, or federal law or regulation; or (e) violates any term or provision of these Official Rules.

The HSUS alone shall determine whether an Entry complies with the above Entry Requirements, and all decisions of The HSUS will be final. If an Entry fails to comply with the above Entry Requirements, as determined by The HSUS in its sole discretion, The HSUS may deem such Entry ineligible. Without limitation, The HSUS also reserves the right, in its sole discretion, to deem any Entry ineligible if it reflects negatively upon The HSUS, the Contest, or any other person or entity; is the subject of a notification of potential infringement or violation of law; is otherwise unsuitable for presentation in a public forum; or for any other reason at the sole discretion of The HSUS.

5. How the Winners Will Be Determined

A panel of judges comprised of members of The HSUS’s staff and teacher consultants from Kind News will select one (1) winner (each individually a “Winner” and collectively, the “Winners”) from each of the three (3) Categories. Entrants will be judged based upon (a) how well the entrant’s cover design embodies the Theme; and (b) the skill level and creativity exhibited by the entrant in his or her creation of the cover design. Judging will take place on or about December 17, 2013. All decisions of the judging panel(s) are final.

6. Prizes

Prizes for Winners

The Winner in each Category will receive one (1) one-year individual home subscription to Kind News (six (6) bi-monthly issues). The Winner’s artwork will also be featured (a) on the cover of the April/May 2014 issue of Kind News and (b) on The HSUS’s website. The Winner’s artwork will be featured on the edition of the April/May 2014 issue that corresponds to the Winner’s Category (i.e., the Winner of the Primary Category will have his/her artwork featured on the Primary edition of the April/May 2014 issue, the Winner of the Junior Category on the Junior edition, etc.). The approximate retail value (“ARV”) of the Kind News subscription is eight dollars ($8 USD). There is no cash value attributed to being featured on The HSUS website and/or in Kind News.

Teacher Coordination Prize

If an Assisting Teacher is included on a Winner’s Entry Form, such Assisting Teacher may be eligible to receive a teacher coordination prize (“Teacher Coordination Prize”) consisting of the following:

  • One (1) one-year classroom subscription to Kind News, consisting of twenty-nine (29) copies of each of five (5) bi-monthly issues published during the school year.
  • One (1) full scholarship for the Assisting Teacher to complete Humane Society University’s Certified Humane Education Specialist (CHES) program. The CHES program consists of five (5) online, professional development courses. The scholarship will be awarded in the form of five (5) individual course certificates that can be redeemed from Humane Society University. All certificates must be redeemed by May 30, 2015 or they will be forfeited.

In order to be eligible to receive a Teacher Coordination Prize, the Assisting Teacher must (a) be a legal resident of the fifty (50) United States or the District of Columbia; (b) be eighteen (18) years of age or older; (c) be the current teacher of the Winner at the time Winner’s Entry was submitted; and (d) currently teach at a school that is based in the fifty (50) United States or the District of Columbia. The HSUS may verify an Assisting Teacher’s eligibility prior to awarding a Teacher Coordination Prize.

The HSUS will award up to three (3) Teacher Coordination Prizes. The total ARV of each Teacher Coordination Prize is six hundred twenty-six dollars ($626 USD).

Shelter Coordination Prize

If an Assisting Shelter is included on a Winner’s Entry Form, such Assisting Shelter may be eligible to receive a shelter coordination prize (“Shelter Coordination Prize”) consisting of the following:

  • Two (2) one-year subscriptions to Animal Sheltering magazine (six (6) bi-monthly issues).
  • One (1) full scholarship for one (1) representative of the Assisting Shelter to complete Humane Society University’s Certified Humane Education Specialist (CHES) program. The CHES program consists of five (5) online, professional development courses. The scholarship will be awarded in the form of five (5) individual course certificates that can be redeemed from Humane Society University. All certificates must be redeemed by May 30, 2015 or they will be forfeited.
  • One (1) one-year classroom subscription to Kind News, consisting of twenty-nine (29) copies of each of five (5) bi-monthly issues published during the school year.

In order to be eligible to receive a Shelter Coordination Prize, the Assisting Shelter must (a) be a currently operating animal shelter or rescue organized under the laws of the United States; and (b) be currently recognized by the Internal Revenue Service as a public charity under section 501(c)(3) of the Internal Revenue Code. The HSUS may request proof of an Assisting Shelter’s 501(c)(3) status or otherwise verify an Assisting Shelter’s eligibility prior to awarding a Shelter Coordination Prize.

The HSUS will award up to three (3) Shelter Coordination Prizes. The total ARV of each Shelter Coordination Prize is seven hundred fifty-one dollars and eighty-five cents ($751.85 USD).

The total ARV of all Contest prizes is four thousand one hundred fifty-seven dollars and fifty-five cents ($4,157.55 USD).

7. Notification of Winners and Prize Recipients/Prize Claims

Winner Notification

The Winners will be selected and the Winners’ respective parents or legal guardians will be notified by telephone and/or email on or about December 18, 2013. The Winners (and their respective parents or legal guardians) may be required to complete and sign an Affidavit of Eligibility and Liability Release, a W-9, and, where legal, a Publicity Release, all of which must be returned within thirty (30) days of attempted prize notification or the prize will be forfeited and awarded to an alternate Winner. If the prize is won by an eligible person who is not of legal age in his or her state of residence, the prize shall be awarded in the name of the Winner’s parent or legal guardian, who must sign and return all required documentation prior to receiving the prize. In the event that a Winner is unable to accept a prize, the prize will be forfeited and awarded to an alternate Winner. Further, in the event of noncompliance with these Official Rules, or if a prize or prize notification is unclaimed or returned as undeliverable, the prize will be forfeited and awarded to an alternate Winner.

Prize Recipient Notification

An Assisting Teacher or Assisting Shelter can only win a Teacher Coordination Prize or a Shelter Coordination Prize, respectively, if the entrant who submitted the Entry naming such Assisting Teacher or Assisting Shelter (a) has submitted any and all required documentation to The HSUS; (b) is confirmed as a Winner; and (c) agrees to accept the associated prize. The winning Assisting Teacher(s) and/or Assisting Shelter(s) (each a “Prize Recipient” and collectively, the “Prize Recipients”) will be notified by telephone and/or email following the notification and confirmation of the Winners. Prize Recipients may be required to complete and sign an Affidavit of Eligibility and Liability Release, a W-9, and, where legal, a Publicity Release, all of which must be returned within thirty (30) days of attempted prize notification or the prize will be forfeited and may be awarded to an alternate Prize Recipient, at The HSUS’s sole discretion. Prize recipients may also be required to provide documents verifying their eligibility, at The HSUS’s sole discretion. If a Prize Recipient’s employer has a policy prohibiting the awarding of a prize to an employee or if a Prize Recipient is otherwise unable to accept a prize, the prize will be forfeited and may be awarded to an alternate Prize Recipient at The HSUS’s sole discretion. Further, in the event of noncompliance with these Official Rules, or if a prize or prize notification is unclaimed or returned as undeliverable, the prize will be forfeited and may be awarded to an alternate Prize Recipient, at The HSUS’s sole discretion.

8. Prize Restrictions

Prizes are not transferable. No substitution of prizes is permitted except at the sole discretion of The HSUS, and The HSUS reserves the right to substitute a prize or any portion thereof with one of equal or greater value. Any federal, state, local, or other taxes of any kind on prizes and any expenses related to the acceptance and/or use of the prizes not specified herein as being awarded are the sole responsibility of the Winner or Prize Recipient. If a prize is won by an eligible person who is not of legal age in his or her state of residence, the prize shall be awarded in the name of the Winner or Prize Recipient’s parent or legal guardian, who will assume all responsibilities of the minor Winner or Prize Recipient.

9. Additional Terms

By entering the Contest, each entrant (and his/her parent or legal guardian) unconditionally assigns, transfers, and conveys to The HSUS and its legal representatives, successors, and assigns all of entrant’s right, title, interest, and ownership in the artwork contained on the Template portion of his/her Entry, including all rights under copyright law in the United States and worldwide, and waives any “moral rights” thereto. Further, each entrant (and his/her parent or legal guardian) acknowledges and agrees that The HSUS shall have the right to modify, edit, adapt, alter, and/or reproduce the artwork contained on the Template portion of the Entry without notification or payment to entrant.

By participating in the Contest, each entrant, Assisting Teacher, and/or Assisting Shelter (and their respective parents or legal guardians, if applicable) consents to The HSUS’s use of his or her name, likeness, voice, and/or biographical information for promotional and other purposes without additional compensation, except where prohibited by law.

By participating in the Contest, each entrant, Assisting Teacher, and/or Assisting Shelter (and their respective parents or legal guardians, if applicable) acknowledges compliance with these Official Rules and agrees to release The HSUS, Humane Society University, and their respective affiliates, officers, directors, employees, independent contractors, representatives, and agents (“Releasees”) from and against any claim or cause of action arising out of participation in the Contest or the receipt, redemption, or use of any prize, including any injuries or damages of any kind sustained in connection with the use, acceptance, possession, or awarding of any prize.

10. Limitation of Liability

Releasees are not responsible for printing, typographical, human or other errors of any kind in any Contest-related materials or for stolen, lost, late, misdirected, damaged, returned, postage due, separated, undelivered, incomplete, unintelligible, or illegible Entries. Releasees are also not responsible for malfunctions of electronic equipment, computer hardware, or software; problems downloading or printing the Entry Form, Template, or other material; or other technical problems related to any website, including, without limitation, any injury or damage to any computer or computer equipment related to or resulting from participation in the Contest or downloading materials for the Contest. Releasees make no warranty, representation, or guarantee, whether express or implied, in fact or in law, relative to the use of any prize or any portion thereof.

If, for any reason, the Contest is not capable of running as planned, or infection by computer viruses, bugs, or tampering, unauthorized intervention, fraud, actions of entrants, technical failures, or any other causes corrupt or infect the administration, security, fairness, integrity, or proper conduct of the Contest, The HSUS reserves the right at its sole discretion to disqualify any Entry or entrant and/or to cancel, terminate, modify, or suspend the Contest and at its sole discretion award a prize from among all eligible non-suspect Entries validly received prior to the action requiring such modification. Persons found to be tampering with or abusing any aspect of the Contest, as determined solely by The HSUS, will be disqualified along with all associated Entries. By entering the Contest, each entrant and his/her parent or guardian agrees that the Contest is governed only by the laws of the District of Columbia for the resolution of all claims and disputes (excluding any claims against or disputes involving parties other than The HSUS relating to any prize awarded in the Contest).

11. Privacy

Information submitted in connection with the Contest will be treated in accordance with these Official Rules and The HSUS’s privacy policy (the “Privacy Policy”), which may be amended from time to time and which is currently available at humanesociety.org/privacy.html. If there is any conflict between these Official Rules and the Privacy Policy, the terms and conditions of the Official Rules shall prevail.
